“HealthGear” and the “HealthGear Services” are a set of Services offered to users needing to manage a variety of health conditions.
Clearfield Software Limited (“Clearfield”, “we”, “us”) is the legal entity responsible for HealthGear.
You consent to the storage and processing by Clearfield of any personal information you have provided, as described herein.
You acknowledge that some of the personal information collected and processed for the HealthGear Services may be considered to be sensitive data under applicable law, and you consent to its storage and processing for the purposes of providing HealthGear Services to you.
You acknowledge that this information may be visible to persons engaged in the provision, development and support of HealthGear.
You acknowledge that this information may be shared with other users of the HealthGear Services, provided you first give permission to share information. A user can provide permission when requested in the phone or web application.
You have the right to withdraw your consent at any time, by discontinuing use of the Services, deleting your account, and deleting the HealthGear App from your devices.
You have the right to delete or deactivate your HealthGear account at any time. This can be done on the web application associated to the corresponding phone application.
Clearfield is committed to respecting and protecting the information of all users who use HealthGear and the HealthGear Services.
We will not use any of your personal information for any purpose other than the provision of HealthGear Services.
We will not disclose any of your personal information to any third party, unless you have first given your permission.
We will not use your personal information for marketing or advertising purposes.
We may use your personal information to contact you directly, but only where the communication relates to your HealthGear account.

You must create a HealthGear account in order to use the HealthGear Services.
To create an account you must provide your real name, your email address, and a password.
You may optionally provide further information such as your address, phone number, gender, age, height, weight, and information related to your health management.
You are not required to provide any information marked as optional, but you acknowledge that some of the HealthGear Services cannot be offered effectively if certain personal information is missing.
Should you wish to synchronise information across multiple devices or share with health care providers we will store appropriate health information collected as you monitor your health.
Some of this information collected may be considered to be sensitive data under applicable laws, and you grant Clearfield your prior opt-in consent for the processing of this data, pursuant to the applicable laws.
If you chose to enable any location-based feature in HealthGear, we will collect data about your physical location from your mobile device. Your Operating System settings will need to be set to allow HealthGear to access location data. By enabling any such feature, you grant Clearfield your prior opt-in consent for the processing of location data.
If you do not consent to the collection or processing of physical location data from your mobile device, you should disable all location-based features in HealthGear, and set your Operating System settings to disallow HealthGear access to location data.
We will collect any information you provide when you communicate with us. We will also collect information that you submit if you participate in a promotional event.
You agree not to post any content that includes information that could identify another person, without that person’s explicit consent.
You agree not to post any content that includes sensitive data about any other person, without that person’s explicit consent.
We ask all HealthGear users to respect by these terms.
Despite these terms, we cannot control whether other HealthGear users may post information about you. If you believe another user has posted sensitive information about you, without your consent, you can contact us to request that the information be deleted.
Other HealthGear users may provide your contact information (email address or phone number) to us, in order to invite you to use HealthGear. This information will not be visible to, disclosed to, or shared with any other party. It will only be used so that we can contact you directly, one time. Once we have done this, we will delete the information.
We collect standard internet data from everyone who uses our Services. We use common technologies to collect information such as your username, IP address or device ID, web browser, mobile device type, HealthGear App type, date and time, and the Services being used. This data is for internal analytical purposes, and is not available to any HealthGear users.
We do not share the data we collect through these technologies with any third party, for any purpose.
We may use analytics on the data collected, to determine user engagement, to analyze the effectiveness of our Services, to investigate technical problems, and to continually improve HealthGear.
Apple HealthKit and Google Fit allow health information to be shared across multiple applications on the same device. This information may be shared with other systems depending on the configuration of the phone. This is outside the control of the HealthGear applications and must be managed by the user directly.
We use your information to provide the HealthGear Services. This includes personalizing, analyzing, improving and promoting the HealthGear Services.
Your contact information held by us is used to communicate with you. Communication can be by email, push notifications, or text messages.
We may send administrative messages to you, such as messages related to account management, customer service, or system maintenance.
We may send promotional messages to you, to inform you about new features or products that we think you would be interested in. However you may opt out of this service at any time. This will be done either by the settings in the application or the associated web application.
Your contact information held by us will not be shared with, or disclosed to, any other parties or any other HealthGear users, unless you have given explicit prior permission to do so.
Your username or screen name are not considered sensitive information, and these may be visible to other users during the normal use of HealthGear.
Any analytic data released publicly by HealthGear will be in the form of aggregated data, from which it will not be possible to identify any individual user or any individual user’s data.
We may share information we receive from you with vendors or service providers that we use in connection with providing HealthGear Services, and who perform those Services on our behalf. We authorize these service providers to use or disclose the information only as necessary to perform the Services on our behalf, or to comply with legal requirements. We require these service providers to appropriately safeguard the privacy and security of all personal information they process on our behalf.
We may access, share or disclose any of your information, if we have your informed consent to do so.
We may access, share or disclose HealthGear information when directed to do so, to comply with law enforcement requests or with legal process such as court orders.
We may access, share or disclose HealthGear information in order to respond to your requests, or if it becomes necessary in order to protect any party’s rights, property, or safety.
The HealthGear Services are intended for use by adults. By using the HealthGear Services, you warrant that you are 18 years of age or older.
If Clearfield is involved in a merger, acquisition, reorganization, liquidation, receivership, or transition of service to another provider, your information may be transferred as part of such a transaction, as permitted by law and/or contract.
We use technical and procedural safeguards to help us protect the integrity and security of personal information that we collect and store. However, no security measures are perfect, and we cannot ensure or warrant the security of any personal information. You agree that you will not hold Clearfield liable for the consequences of any loss or breach of security.
The HealthGear Services are controlled and operated from New Zealand, and your personal information will be stored and processed in New Zealand. The laws of New Zealand and the jurisdiction of New Zealand courts apply to any matters that may arise.
You have the right to update, correct, or delete your account and your personal information at any time. If you delete your account, we will also permanently delete all of your personal information from HealthGear. If you wish to update, correct or delete parts of your personal information, you can do this through the HealthGear App, or by contacting us at email@example.com.
We may revise this policy from time to time. When we do, we will post the revised policy on this web page, and the revised version will be effective when it is posted. If we make any material changes to this policy, we will notify you of such changes by posting them on this page or by sending you an email or other notification, and we will indicate when such changes will become effective. By continuing to access or use the HealthGear Services after those changes become effective, you are agreeing to be bound by the revised policy.
